Pay Contest or Defer Tickets
How a ticket is handled depends on the court, the violation, and the driver's eligibility. The prosecutor's infraction deferral program is designed for otherwise law-abiding drivers who recently received a traffic ticket. The program can result in dismissal if the driver completes the agreement. Most moving violations require a 12-month clean-record term, while non-moving violations use a three-month term.
A driver may apply only after 10 days have passed since the ticket. If accepted before the scheduled court date, the driver does not need to appear in court. If rejected, the driver must attend the court date or contact the clerk to pay. Out-of-state drivers must submit a certified three-to-five-year driving record, and third-party records are not accepted. CDL holders are not eligible if driving in any capacity.

Court Record vs BMV Record
The county traffic case and the Indiana BMV driver record answer different questions. The court file shows what happened in the citation case. The driver record shows license status, points, suspensions, violations, convictions, and reinstatement requirements. A court dismissal or deferral completion may prevent BMV forwarding in the local program, but the driver should still check BMV status if license action is a concern.
